To apply for international trademark registration in other countries, the trademark must first be registered in the country of origin. Therefore, the internal registration of a trademark in the country of origin is a prerequisite for the international registration of a trademark in the member countries of the Madrid system.

Applying for international trademark registration is possible only through the Industrial Property Office. The first step is to fill in the trademark declaration form with the Industrial Property Office, which is responsible for trademark registration. This application form must include the details and specifications of the requested mark such as color, form, a list of related goods or services according to the International Classification of Trademarks contained in the trademark applied for and other specifications of the mark.

A trademark must be special and distinctive so that consumers can recognize the product by looking at and also distinguish it from other trademarks and other products that are introduced under that trademark. A trademark should not mislead or deceive the consumer, or cause public order to be destroyed or immoral.

The rights granted to one trademark will not necessarily be the same as the rights granted to another trademark. This is determined through investigations conducted by the Trademark Office or as a result of third parties claiming similar rights.
